1. Acceptance of Terms

These Terms of Service (“Terms”) form an agreement between you and Aidin Bazarchi, an individual based in Türkiye who operates GiftPlanner (“GiftPlanner”, “we”, “us”), governing your use of the GiftPlanner mobile app and the website at giftplanner.app (together, the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who can use the Service

You must be at least 13 years old (or 16 where required by local law) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms. By using the Service you represent that you meet these requirements.

3. What GiftPlanner does

GiftPlanner helps you remember important dates and plan personalized gifts using AI: it generates gift suggestions, cake designs, birthday and occasion messages, and digital postcards tailored to the interests of the people you add, and sends you reminders. The Service is available as a mobile app (iOS and Android) and as a website.

4. Your account

Provide accurate information and keep it up to date.
Keep your login credentials secure; you are responsible for activity under your account.
One person may maintain a single account; don't share it or let others use it.
Tell us promptly if you suspect unauthorized use.

5. Your content & information about others

You may add information about yourself and about the people you're celebrating (“Friends”), and you may upload photos and notes. You represent that you have an appropriate basis to provide any information about another person, that you will add only what is needed, and that you will not add information about anyone who has asked you not to. Do not upload content that is unlawful, infringing, or that you don't have the right to share.

You keep ownership of the content you provide. You grant GiftPlanner a limited license to host, process, and use that content solely to operate and provide the Service to you (including sending it to the AI and infrastructure providers described in our Privacy Policy). You can delete your content or your whole account at any time.

6. Plans, limits & billing

GiftPlanner offers a free plan with usage limits (for example, a monthly cap on certain AI generations) and may offer a paid Premium plan with higher limits and additional capabilities. Free-plan limits may change as we tune the Service.

Where paid subscriptions are offered in the App, they are sold and billed through the Apple App Store or Google Play and are subject to those stores' terms. Subscriptions renew automatically unless cancelled, and you manage or cancel them in your App Store or Google Play account; deleting the app does not cancel a subscription. Except where required by law or store policy, payments are non-refundable. Prices and plan features may change prospectively.

7. Acceptable use

You agree not to:

use the Service for any unlawful, harmful, or abusive purpose;
upload harmful, offensive, infringing, or unlawful content, or content about others without a proper basis;
attempt to reverse-engineer, scrape, or extract the underlying AI models or data, or circumvent usage limits, rate limits, or security;
impersonate any person or entity, or misrepresent your affiliation;
use the Service to generate content that harasses, defames, or violates others' rights; or
interfere with or disrupt the integrity or performance of the Service.

8. AI-generated content

Gift suggestions, cake designs, messages, and postcards are produced by automated AI systems and are provided as recommendations only. They may be inaccurate, unavailable, or unsuitable, and product details, prices, and availability can change. Review AI output before relying on it, and verify any product, price, or vendor before purchasing. Subject to applicable law and these Terms, content generated for you is licensed to you for your personal, non-commercial use.

9. Third-party products, links & affiliates

The Service may show third-party products, store listings, maps, and links (for example, nearby shops or online retailers). We don't control and aren't responsible for third-party sites, products, or services, and your dealings with them are governed by their terms. Some links may be affiliate links, meaning we may earn a commission if you make a purchase, at no extra cost to you.

10. Intellectual property

The Service — including its software, design, logos, and underlying technology — is owned by GiftPlanner and its licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. We welcome feedback, and you grant us the right to use any feedback you provide without obligation to you.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or suitable. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, GiftPlanner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Nothing in these Terms limits liability that cannot be limited under applicable law (such as your statutory consumer rights).

13. Indemnification

You agree to indemnify and hold GiftPlanner harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, your violation of these Terms, or your violation of any law or the rights of a third party — including any person whose information you add to the Service.

14. Suspension & termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. On termination, the licenses granted to you end; sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

15. Governing law & disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules, and the courts and consumer arbitration committees of Türkiye will have jurisdiction — except where mandatory law gives you, as a consumer, the right to bring or require proceedings in your own country of residence. Nothing in this section removes the mandatory consumer-protection rights you have where you live, including, for users in Türkiye, under the Consumer Protection Law No. 6502.

16. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version here and change the “Last updated” date, and for material changes we'll provide a more prominent notice (such as email or an in-app message). Continued use of the Service after changes take effect constitutes acceptance.
